Types of product liability claims

There are three main types of product liability claims

The first is manufacturing defect cases, in which the product is designed well, but the way it was constructed makes it unsafe. For instance, if a toy wagon was assembled without a bolt that kept one of the wheels on.

The second is design defect cases in which the design of the product is unsafe, so the entire product line is unreasonably dangerous. Design defects also apply to the way a product is packaged. For example, a car seat that does not properly secure the child into the seat.

The third general type of product liability claim is insufficient instructions or warnings, in which the manufacturer designs a product that has no foreseeable flaws, but then fails to include proper warnings or instructions for safe operation. Recovering the packaging, instructions, or warnings is an important part of strengthening your product liability case. For example, prescription drugs that do not list certain side effects.
