How Long Do You Have to File a Personal Injury Claim in Colorado?
The statute of limitations on most personal injury cases in Colorado is two years. This means that, in most cases, you have just two years from the date of the accident, injury, or death to file your personal injury or wrongful death lawsuit. If you fail to bring your claim in court before the statute of limitations expires, the court will most likely dismiss your case.
Note that the statute of limitations applies to lawsuits only, not insurance claims. In fact, the amount of time you have to file an insurance claim after an accident or injury is often much less—typically only several days to a couple of weeks.
If you were injured in an accident or if someone you love passed away due to the negligence of another, we at Mike Slocumb Law Firm encourage you to take immediate action. Reach out to our team right away to learn how we can help you build your case and fight for the fair compensation you are owed before the filing deadline passes.

While filing a personal injury claim can provide the injured party and/or their family with a much needed and deserved sense of justice and closure, the main point of bringing a claim is to recover financial compensation for economic and non-economic losses. Collectively known as “damages,” these losses range widely depending on the specific details of each unique situation.
That being said, some common types of damages that can be recovered in personal injury cases in Colorado include:
- All medical expenses related to the plaintiff’s injury, including future medical costs
- Physical and mental pain and suffering
- Lost income, wages, and employment benefits, including future earnings
- Lost or reduced earning capacity due to a temporary or permanent disability
- Diminished quality and/or enjoyment of life
- Miscellaneous out-of-pocket expenses, such as the cost of modifying a home to accommodate a new disability or expenses related to in-home assistance and care
In some cases, eligible individuals may be entitled to punitive damages. Unlike the compensatory damages described above, punitive damages are not meant to compensate the plaintiff for specific economic or non-economic losses. Instead, the purpose of punitive damages is to punish the defendant. As such, punitive damages are generally only available in cases involving gross negligence and/or willful, wanton, or intentional misconduct.
At Mike Slocumb Law Firm, we carefully evaluate our clients’ claims to determine what types of damages they are entitled to recover, as well as the potential value of their claims. Our Denver personal injury lawyers leave no stone unturned and no avenue unexplored when it comes to maximizing our clients’ recoveries.
