Can You Sue Another Driver After a Car Accident in Texas?
Because Texas follows a fault-based car insurance system, it is possible to bring a claim or lawsuit against a negligent driver after an accident. However, in most cases, the first step in seeking compensation after a crash is filing an insurance claim with the at-fault driver’s insurance carrier.
To file an insurance claim or lawsuit against an at-fault driver, you will need to prove that:
- You were injured
- Your injuries led to measurable damages
- The other driver was mostly or entirely at fault for the accident
- The accident was the direct or proximate cause of your injuries and damages
If the insurance company refuses to pay a fair settlement, or if the at-fault driver is uninsured or underinsured, it may be in your best interest to file a lawsuit directly against the liable party and seek compensation for your damages in court.
We strongly recommend that you work with an experienced auto accident attorney, even if your case seems fairly straightforward. Insurance adjusters will often do everything possible to dispute or deny these claims. They may argue that you were more at fault for the accident than the insured party, or they may assert that your injuries are related not to the accident but to a preexisting condition or old injury. Our attorneys at Mike Slocumb Law Firm can help you fight back against the insurance company’s efforts to dispute your claim and work to recover the full, fair amount you are owed for your losses.

What Happens If Both Drivers Are at Fault in an Accident in Texas?
Sometimes, a single motorist is responsible for an accident. More often, however, multiple parties share some of the blame. When this is the case, and you were party at fault for the crash that caused your injuries, you could still be entitled to file a personal injury claim.
Texas follows a rule of modified comparative fault. Under this rule, you can file a personal injury claim and seek compensation for your damages if you were no more than 50% at fault for the incident that led to your injuries. However, if you are found to be partly at fault, you cannot recover the full amount you are seeking in compensation. Instead, your total recovery will be reduced by your at-fault percentage. So, if the insurance company and/or court finds you 25% to blame for the crash, you can only recover up to 75% of the total amount you are seeking in damages.
Insurance companies often use this rule to devalue valid car accident claims. The insurance adjuster might argue that you were more at fault, meaning you are only entitled to limited compensation. At Mike Slocumb Law Firm, our Houston car accident lawyers know how to fight back against these tactics, as well as other efforts by the insurance company to dispute your claim or lower your settlement. In every case, we fight tirelessly for maximum compensation for our clients. Our aggressive approach has helped us recover more than half a billion dollars in compensation for our clients, and we are ready to protect your rights and advocate for the full recovery you are owed.
What Types of Damages Can You Recover in a Car Accident Claim?
“Damages” is a legal term that refers to the economic and non-economic losses an individual suffers as a result of an accident, injury, or the death of a loved one. While every case is different, and the exact types of damages you can expect to receive in your car accident claim depend on the unique factors involved, many injured accident victims are able to recover certain damages.
Common damages in car accident claims include:
- Medical expenses
- Future medical expenses
- Pain and suffering
- Lost income/wages
- Loss of earning capacity
- Diminished quality of life
In some cases, you may be entitled to punitive damages. Also known as “exemplary” damages, punitive damages are meant to punish the defendant for gross negligence or acts of willful, wanton, or intentional misconduct.
