Can You File a Car Accident Claim If You Were Partly at Fault? 

Under Illinois’ modified comparative fault system, you can file a claim after a car accident if you were partly at fault for the crash. However, you must prove that you were no more than 50% at fault for the accident to still be eligible for compensation.

Additionally, if you are found to be partly at fault, the amount you can recover in damages will be reduced by your at-fault percentage. So, for example, if you were injured after being hit by someone who ran a red light, but you were going five miles over the posted speed limit when the accident occurred, the insurance adjuster and/or court might find you 10% to blame. If you suffered $10,000 in damages, you would only be eligible to recover up to 90% of that amount, or $9,000.
